Terms of Service

These Terms of Service (“Terms,” “Agreement,” “ToS”) constitute a legally binding agreement between you (individually or as an authorized representative of your entity) (“User,” “you,” “your”) and Brihat Infotech Private Limited (“Company,” “we,” “us,” “our,” “Brihat Infotech,” “Provider”).

These Terms govern your access to and use of the Brihat Books website (www.brihatbooks.com), mobile applications (iOS and Android), and all associated services, features, content, and documentation (collectively, “Services” or “Product”). By accessing, browsing, registering for, or using any part of Brihat Books, you agree to be bound by these Terms. If you do not accept all terms, do not use the Services.


1. Eligibility and Account Registration

1.1 Eligibility Requirements

By using Brihat Books, you represent and warrant that you are at least 18 years of age, possess the legal capacity to enter binding contracts, operate your business in India (primary jurisdiction), and are authorized to represent the business entity associated with the account.

1.2 Business Account Requirements

Your business must be operating legally in India. You must comply with all applicable tax laws, including the GST Act and the Income Tax Act.

1.3 Account Registration & Verification

You must provide accurate, current, and complete details, including a valid mobile number, business name, and business type. You are responsible for keeping credentials secure and for all actions taken under your account.

1.4 Account Suspension

We reserve the right to suspend or terminate accounts immediately if false credentials are used, terms are violated, or transactions show security risks or payment failures.


2. Services Description

Brihat Books provides invoice generation, automated GST filing structures, stock/inventory tools, payment reconciliations, Point-Of-Sale terminal features, OCR bill scanning, WhatsApp bot notification modules, and AI-assisted bookkeeping assistance.

Services are provided “as-is” and “as-available”. While we aim for 99.9% uptime, we do not guarantee uninterrupted system access.

Not Legal or Tax AdviceBrihat Books provides automated utility tools but does NOT provide professional legal, tax, or Chartered Accountancy advice. Always consult a certified professional (CA) to review your final tax returns and compliance obligations.

3. Subscription Plans and Pricing

We offer three subscription tiers:

  • Starter Plan: ₹0 per month. Limited to 50 invoices/month, 1 user, basic dashboard preview. No filing or AI assistant tools.
  • Professional Plan: ₹999/month (or ₹799/month billed annually). Unlimited invoicing, up to 5 user profiles, full GST filing, inventory tracking, POS terminal, WhatsApp automation, and priority helpdesk support.
  • Enterprise Plan: Custom pricing. Dedicated managers, custom integrations, API logs, and SLA guarantees.

3.2 Pricing Changes

Pricing is subject to adjustment upon 30 days' advance email notice to active subscribers.

3.3 Auto-Renewal and Billing

Billing occurs monthly or annually. Transactions are processed via Razorpay. Failed payments result in a 3-day notice period before account access is suspended.

Strict No-Refunds PolicyAll sales are final. We do not provide refunds or credits for partial subscription periods, unused features, or voluntary account downgrades. Exceptions are made solely for verified duplicate billing errors.

4. User Responsibilities and Conduct

You may not engage in prohibited practices, including:

  • Falsifying invoice records or participating in GST evasion schemes.
  • Attempting to compromise system security, reverse-engineer code, or script mass data scraping.
  • Spamming or sending unsolicited marketing content via the WhatsApp Business integration.
  • Uploading malware, malicious code, or files that violate intellectual property laws.

5. Intellectual Property Rights

The Brihat Books platform design, code patterns, logo, and original copy remain the exclusive intellectual property of Brihat Infotech Private Limited.

Your Business Data remains entirely yours. We do not claim ownership of invoices, product inventories, or financial sheets generated on your account.


6. Limitations of Liability and Disclaimers

Disclaimer of Warranties:

BRIHAT BOOKS IS PROVIDED “AS-IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE, OR ABSOLUTE SECURITY. WE DO NOT GUARANTEE THAT FINANCIAL REPORTS OR GST CALCULATIONS WILL BE FREE OF OMISSIONS.

Limitation of Liability:

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL BUSINESS LOSSES (INCLUDING LOST PROFITS, REVENUE, OR DATA CORRUPTION). TOTAL LIABILITY IS STRICTLY CAPPED AT THE LESSER OF THE SUBSCRIPTION FEES PAID BY YOU IN THE PRECEDING 12 MONTHS OR INR 10,000.


7. Indemnification

You agree to defend, indemnify, and hold harmless Brihat Infotech and its employees from claims, tax penalties, audit adjustments, or legal expenses arising from your violation of these Terms, non-compliance with tax laws, or misuse of customer records.


8. Service Uptime and Maintenance

We schedule routine technical maintenance during off-peak hours and provide 48-hour notices when possible. We are not liable for outages caused by force majeure events or external networks (such as AWS, telecom ISPs, or the official GST portal). Uptime credits are issued strictly under the schedule outlined in our Enterprise agreements.


9. Third-Party Services and Integrations

Brihat Books links with Razorpay, AWS, Google, Anthropic, and government tax databases. Your use of these services is subject to their respective terms. We do not assume responsibility for technical faults occurring within third-party servers.


10. Chargebacks and Payment Disputes

You must address billing questions directly to info@brihatinfotech.com. Filing a bank chargeback without contacting our support team first will result in immediate account suspension, irreversible data deletion, and a permanent platform ban.


11. Compliance with Laws

Users bear sole responsibility for the timely filing of GST returns, GSTR-1, and income tax statements. You represent that your products do not violate Indian trade regulations. Brihat Infotech will fully cooperate with official tax investigators or court orders requiring data disclosures.


12. Termination and Account Closure

You can close your account through the Settings panel. Closure is immediate, and records are retained for a 30-day export window before deletion (excluding legally mandated tax logs kept for 7-10 years).

Upon termination, all licenses granted under this Agreement expire immediately.


13. Confidentiality

Feedback, bug reports, and features suggestions you share become our intellectual property. We implement data processing covenants to keep your business billing data confidential from unapproved third parties.


14. Modifications to Terms and Services

We modify these terms to remain compliant with evolving Indian tax guidelines. Material revisions will be flagged with 30-day email notices before they become active.


15. Dispute Resolution

All legal disputes must first undergo 30 days of informal negotiations. If informal resolution fails, disputes shall be arbitrated individually (no class actions) under the Arbitration and Conciliation Act, 1996.

16. Severability and Entire Agreement

If any provision of these Terms is deemed invalid by an arbitrator, the remaining sections will continue in full effect. This Agreement constitutes the entire contract between the parties.


17. Export Compliance

Our services are subject to export control regulations of India. You warrant that you are not on government watch lists or operating in trade-sanctioned jurisdictions.

19. Special Provisions

Chartered Accountants accessing the client portal must maintain active ICAI memberships and abide by professional confidentiality regulations. Invited employees' actions remain the liability of the business account owner.


20. Definitions

“Brihat Books” refers to the SaaS platform, web app, and APIs. “User” represents the account holder. “Provider” is Brihat Infotech Private Limited. “ICAI” refers to the Institute of Chartered Accountants of India.
