TDS Kya Hota Hai?

TDS ka full form hai Tax Deducted at Source. Concept simple hai: jab aap kisi ko payment karte ho, toh government ka ek hissa pehle hi kaat ke direct government ko bhej dete ho. Baaki amount recipient ko milti hai. Isse government ko tax collection advance mein mil jaata hai aur tax evasion bhi kam hoti hai.

Example: Aapne ek contractor ko ₹1,00,000 ki payment karni hai. TDS rate 1% hai — toh aap ₹1,000 TDS kaat ke government ko bhejoge, aur contractor ko ₹99,000 milega. Contractor baad mein apni ITR mein ye ₹1,000 TDS credit claim karega.

Kab TDS Deduct Karni Hoti Hai?

TDS sirf certain types of payments pe aur threshold exceed karne pe applicable hoti hai. Common cases niche diye hain:

  • Contractor/Sub-contractor Payment: Single payment ₹30,000 se zyada ya ek financial year mein total ₹1,00,000 se zyada — TDS Section 194C under.
  • Rent Payment: ₹2,40,000 per year se zyada rent pay karte ho toh TDS Section 194I under applicable.
  • Professional Services (Doctor, Lawyer, CA, etc.): ₹30,000 se zyada single payment ya ₹1,00,000 annually — Section 194J.
  • Salary: Employee ko salary pe TDS Section 192 under, projected annual salary pe based.
  • Interest on Loans: Bank se bahar kisi se loan pe interest pay karo toh Section 194A applicable.

Common TDS Rates

  • Section 194C (Contractor): 1% individual/HUF, 2% others
  • Section 194J (Professional/Technical Services): 10% professional fees, 2% technical services
  • Section 194I (Rent): 10% land/building, 2% plant/machinery
  • Section 192 (Salary): As per applicable income tax slab
  • Section 194A (Interest): 10%
  • Note: Agar recipient ne PAN nahi diya toh TDS rate 20% ya normal rate — whichever is higher.

TDS Deposit Kaise Karein?

TDS deduct karne ke baad use government mein deposit karna hota hai. Process ye hai:

  1. Challan 281 bharo: Income Tax e-filing portal pe jaao, Challan 281 fill karo. Correct section code, nature of payment, aur amount daalke net banking se pay karo.
  2. Quarterly Returns file karo (Form 26Q): Har quarter ke TDS ka consolidated return Form 26Q mein file karna hota hai. Salary ke liye Form 24Q, non-salary ke liye Form 26Q.
  3. TDS Certificate issue karo (Form 16/16A): Jis person ka TDS kataa hai use certificate dena hota hai — salary pe Form 16, baaki ke liye Form 16A.

Due Dates: TDS deposit — generally 7th of next month (March ka 30th April tak). Quarterly return — 31st July, 31st October, 31st January, 31st May.

TDS Deduct Nahi Ki Toh Kya Hoga?

TDS compliance miss karne pe serious consequences hain. Sabse pehla — aapka woh expense Income Tax Act mein disallow ho sakta hai. Matlab agar aapne ₹5 lakh contractor ko diya aur TDS nahi kata, toh income tax calculation mein woh ₹5 lakh expense aapko minus nahi milega — aapka taxable income zyada hoga.

Penalty bhi lagti hai — 1.5% per month interest on TDS amount from date of deduction to date of payment. Plus penalty equal to TDS amount under Section 271C. Isiliye ignore karna risky hai.

Chhote Business ke liye Practical Note

Agar aap small business ho aur turnover ₹1 crore se kam hai, toh aapko TDS deduct karna mostly mandatory nahi hota — because TDS ka obligation generally "persons liable to get accounts audited" pe hota hai. Lekin ek baar apne CA se verify zaroor karo kyunki rules aapki business type pe depend karte hain.

Agar aap growing ho aur audit threshold cross karne wale ho, toh pehle se TDS systems setup kar lo. Baad mein compliance catch-up karna zyada costly hota hai.
